is it impossible to open a checking account, during bankruptcy?

since may of this year i stopped paying my credit cards because of financial status. i’m enrolled in a payment plan to file for bankruptcy. i use my checking account to pay utilities, car payments, and rent.one of the credit cards was with my bank. now i’m trying to open a checking account with a different bank just to pay bills and not loose the little money i have with my original bank.i was denied today with a certain bank because of my so called credit, yet i’m not looking for a credit card, but a way to pay bills.

Without permission from the bankruptcy court, it is illegal to open or close ANY account.

Check around, there are some banks that will let you open an account. However, if and when you file bankruptcy you will have to also have the new bank name, account #, and balance listed as one of your assets. You may want to open just a savings account since you already have a checking account for bill paying. If you use a bank debit card, you will only be able to get out what you have in the account and not have to worry about over-draft charges, just don’t write any checks. Hope this helps.

Banks are not obligated to open an account for someone. If you have bad credit, you are a risk to them losing money, and they are in the business to MAKE money.

I am a bankruptcy attorney in California. It is not impossible to open a check account during bankruptcy. It may be difficult and you may need to shop around a bit, but it is not impossible nor is it illegal. I would try a credit union, they usually don’t to credit checks just to open an account.

Just as everyone else stated, credit unions are something you should look into. One of the major benefits of these unions is the leniency they provide when joining. These banks are usually more understanding and are dealt with more flexibility in their options.
