My Bankruptcy attorney’s advice…?
I’m in the process of bankruptcy. My attorney advised me to STOP paying my credit card bills, and to kindly tell the creditors that I am applying for bankruptcy and have them call his office if they have any questions. My question is: During this processes, will the creditors still harass me?

If they harass you, they’ve committed a federal crime subjecting themselves to years in prison and a $250,000 fine.
No, they won’t harass you.

Creditor calls. You reply that I have filed for bankruptcy and until this is settled, I have no further comment. If you would like to speak to my attorney, the number is …
They are not supposed to – some do – most do not. The ones which do get the message real quick when you say that you filed and the lawyer’s number is thus and so.
Unfortunately, the process takes a fairly long period of time and they don’t know until you tell them or until they check. They are not really harassing you, although it seems like it…they just do not have the official word yet. Be polite to them – they are just doing their job. “I filed for bankruptcy. I am not paying on this debt for the time being. If you want the status of my case, call Mr. *** at *****.” That is all you need say. If they get nasty – hang up.
It does take a fairly long period for them all to be notified…so expect a call from time to time. Refer them to the lawyer. They won’t call him. Simply saying that you have declared bankruptcy alerts them that the thing has not yet gone into their system…they will not call again for a month or so…it takes THAT long for it to go through.
